Disclaimer, Terms of Use & Privacy Policy

1. Medical & Educational Disclaimer
Effective: May 26, 20261.1 Educational content only
All content published on drneilpatelmd.com (the “Site”), including but not limited to written articles, FAQ entries, the symptom awareness tool, the interactive brain anatomy module, the resource hub, glossary, and any embedded videos, infographics, or downloads (collectively, the “Content”), is provided strictly for general educational and informational purposes. The Content is not intended as, and shall not be construed as, medical advice, diagnosis, treatment, or a substitute for the professional judgment of a qualified licensed healthcare provider.
1.2 No physician–patient relationship
Accessing, viewing, downloading, or otherwise using the Site does not create a physician–patient relationship between the user and Dr. Neil J. Patel or any other contributor. A physician–patient relationship can only be established through formal clinical engagement, including (i) a scheduled clinical encounter, (ii) execution of any required intake or consent documentation, and (iii) compliance with the policies of the clinical practice or telehealth platform through which care is delivered (including, but not limited to, Neura Health for current patient services).
1.3 No diagnosis, no treatment, no prescriptions
Nothing on this Site diagnoses any medical condition, prescribes any medication, recommends any specific treatment, or constitutes a clinical evaluation. Tools provided on the Site (including any symptom awareness tool) are educational illustrations of clinical thinking and do not produce a diagnosis, do not stratify clinical risk in any individual user, and do not replace evaluation by a qualified clinician.
1.4 Emergencies
If you believe you or someone in your care is experiencing a medical emergency — including but not limited to a serious head injury, suspected stroke, seizure, loss of consciousness, repeated vomiting after head trauma, worsening headache, slurred speech, weakness, numbness, or any concerning change in neurologic status — call 911 immediately or go to the nearest emergency department. Do not delay emergency evaluation to read or rely on Content on this Site.
1.5 Reliance on Content is at user's own risk
While reasonable effort is made to keep Content accurate and current, medical science evolves. The operator makes no warranty, express or implied, that any Content is complete, current, free of error, or appropriate for any particular user, situation, or clinical context. Any reliance on Content from this Site is at the user's sole risk.
1.6 External links
The Site contains links to third-party websites operated by independent organizations (including, without limitation, the U.S. Centers for Disease Control and Prevention, Boston University CTE Center, Concussion & CTE Foundation, the British Journal of Sports Medicine, the National Library of Medicine / PubMed, and Neura Health). These links are provided as a convenience and a reference for further reading. The operator does not control, endorse, warrant, or assume responsibility for the content, accuracy, privacy practices, or availability of any third-party site. Access of any third-party site is governed by that site's own terms and policies.
1.7 Jurisdiction and scope of practice
The Content is general educational material directed to a national, English-language audience. Nothing on the Site constitutes the practice of medicine in any specific U.S. state or in any foreign jurisdiction, and no Content should be interpreted as offering, soliciting, or providing clinical services in any specific jurisdiction in which the operator is not licensed. Clinical services, where offered, are delivered only through duly licensed channels and only in jurisdictions where the operator is licensed to practice. If you require clinical care, contact a clinician licensed in your state or country.
2. Terms of Use
Effective: May 26, 20262.1 Acceptance
By accessing or using the Site, you agree to be bound by these Terms of Use (“Terms”) and by all applicable laws and regulations. If you do not agree to these Terms, do not use the Site.
2.2 Eligibility
The Site is intended for users who are at least 13 years of age. If you are under 13, do not use this Site or provide any personal information through it. If you are between 13 and 18, you should review this page with a parent or legal guardian.
2.3 Intellectual property
All Content on the Site, including text, graphics, layout, illustrations, code, photographs (including the portrait of Dr. Patel), embedded interactive features, and the overall site design, is the property of Dr. Neil J. Patel, MD, MBA or its content licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. No portion of the Site may be reproduced, distributed, modified, republished, or used to train artificial intelligence or machine learning systems without the prior express written permission of the operator, except that:
- Patients and the general public may share links to the Site freely.
- Healthcare professionals may quote brief excerpts for non-commercial educational use with attribution.
- Fair use under U.S. copyright law is preserved.
2.4 Permitted use
You may view and access the Site for your personal, non-commercial educational use. You agree not to:
- Use the Site or its Content for any unlawful purpose;
- Scrape, harvest, or systematically extract data from the Site by automated means without permission;
- Interfere with the operation, security, or availability of the Site;
- Frame, mirror, or reproduce the Site or any part of it without permission;
- Misrepresent any Content as your own, or remove any copyright, trademark, or other proprietary notices;
- Use the Site to transmit any unlawful, harassing, defamatory, or fraudulent communication;
- Use the Content as input to train a generative AI or machine-learning model.
2.5 No warranty
The Site and all Content are provided “as is” and “as available”, without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, timeliness, or uninterrupted availability. The operator does not warrant that the Site will be error-free, that defects will be corrected, or that the Site or its server is free of viruses or harmful components.
2.6 Limitation of liability
To the fullest extent permitted by applicable law, in no event shall Dr. Neil J. Patel, MD, MBA, any affiliated entity, or any contributor to this Site be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including, without limitation, damages for personal injury, loss of profits, lost data, loss of goodwill, or any other intangible loss — arising out of or in any way connected with (i) your access to or use of the Site, (ii) any reliance on Content, (iii) any third-party links, or (iv) any failure of the Site to operate as intended. This limitation applies regardless of the legal theory asserted (contract, tort, strict liability, statute, or otherwise) and even if the operator has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in such jurisdictions the foregoing limitations apply to the maximum extent permitted by law.
2.7 Indemnification
You agree to indemnify, defend, and hold harmless Dr. Neil J. Patel, MD, MBA and any affiliated parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (i) your use of the Site or the Content, (ii) your violation of these Terms, (iii) your violation of any third-party right, including any intellectual property or privacy right, or (iv) any clinical decision you make in reliance on Content from the Site.
2.8 Governing law & venue
These Terms shall be governed by and construed in accordance with the laws of the State of New York and the federal laws of the United States of America, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state and federal courts located in New York County, State of New York, and you consent to the personal jurisdiction and venue of such courts. For users in any other U.S. state, the substantive content of the Site is general educational material and does not constitute the practice of medicine within that user's state.
2.9 Severability & survival
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. The disclaimer, limitation of liability, and indemnification provisions survive any termination of these Terms.
2.10 Changes to these Terms
The operator may revise these Terms at any time without notice. The version effective at the time of your use of the Site governs. The “Last updated” date at the top of this page indicates the most recent revision. Continued use of the Site after a revision constitutes acceptance of the revised Terms.
2.11 No agency, partnership, or employment
Nothing in these Terms or on the Site creates an agency, partnership, joint venture, employment, franchise, or fiduciary relationship between the user and the operator. Dr. Patel's separate clinical practice through Neura Health is governed by Neura Health's own agreements; nothing here amends those agreements.
3. Privacy Policy
Effective: May 26, 20263.1 Overview — what this Site does and does not collect
This Site is a static informational website. It does not require account creation, does not process payments, and does not collect any health information from visitors through any on-site form. The operator collects only the limited categories of information described below.
3.2 Information you provide voluntarily
If you send an email to contact@drneilpatelmd.com or any other published address, you voluntarily provide the operator with your email address, name (if included), and the contents of your message. This information is used to respond to your inquiry and is retained in the operator's email system for record-keeping. The operator does not sell, rent, trade, or share this information with third parties for marketing purposes.
Important — do not send Protected Health Information (PHI) or sensitive clinical details by email. Email is not a secure or HIPAA-compliant channel. If you need to discuss your personal medical situation, please book a clinical visit through Neura Health or another HIPAA-compliant channel and not by emailing this Site.
3.3 Information collected automatically
When you visit this Site, the hosting provider (Cloudflare Pages or similar static-hosting service) may automatically log standard technical information, including your IP address, browser type and version, operating system, referring URL, pages visited, and timestamps. This information is used for security, fraud prevention, abuse detection, and aggregate analytics. It is not used to build a personal advertising profile. Logs are retained according to the hosting provider's own retention schedule.
3.4 Cookies, analytics, and advertising
This Site uses Google Analytics 4 to collect aggregate usage statistics (pages visited, approximate location, device type). Google Analytics sets cookies and processes data under Google's Privacy Policy. Some features (such as language preference) may use the browser's local storage to remember a setting on the user's own device.
Article pages may display third-party advertising served by an advertising network (such as Google AdSense or Mediavine). Ad partners may use cookies or similar technologies to serve and measure ads; where personalized advertising is used, it is subject to the ad partner's own privacy policy. Visitors in jurisdictions that require consent (including the EEA, UK, and certain U.S. states) will be presented with a consent notice and may decline non-essential cookies. You can also opt out of personalized advertising at Google Ads Settings and aboutads.info.
If you submit the contact form, the information you provide (name, email, organization, message) is transmitted to and stored by the form-processing provider solely to deliver your inquiry; it is not sold or used for advertising.
3.5 Third-party links and embedded content
External links to organizations such as the CDC, the Boston University CTE Center, the Concussion & CTE Foundation, PubMed, Neura Health, and others are governed by those parties' own privacy policies. The operator does not control and is not responsible for their data practices. Review the privacy policy of any third party before submitting information to it.
3.6 HIPAA notice
This Site is not a HIPAA-covered entity in its capacity as a public informational website. No clinical care is delivered through this Site. Clinical care provided by Dr. Patel through Neura Health is governed by Neura Health's HIPAA-compliant privacy practices, which are presented to patients at the point of clinical engagement and are not duplicated here.
3.7 Children's privacy (COPPA)
This Site is not directed to children under 13, and the operator does not knowingly collect personal information from children under 13. If a parent or guardian believes that a child under 13 has provided personal information through this Site, contact the operator at contact@drneilpatelmd.com and the information will be deleted.
3.8 California residents (CCPA / CPRA)
If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know what personal information has been collected about you, the right to request deletion of personal information, the right to correct inaccurate personal information, and the right to opt out of any “sale” or “sharing” of personal information. The operator does not sell or share personal information in the sense defined by CCPA/CPRA. To exercise any of these rights, contact contact@drneilpatelmd.com.
3.9 European Economic Area / United Kingdom (GDPR / UK GDPR)
If you access the Site from the EEA or UK, the lawful bases for any limited processing described above are (i) the operator's legitimate interest in maintaining and securing the Site and responding to inquiries (Article 6(1)(f) GDPR) and (ii) your consent where you voluntarily contact the operator (Article 6(1)(a) GDPR). You have the right of access, rectification, erasure, restriction, portability, and objection. To exercise any of these rights, contact contact@drneilpatelmd.com. You also have the right to lodge a complaint with your local data-protection supervisory authority.
3.10 Other U.S. state privacy laws
For residents of states with comprehensive consumer privacy laws (including but not limited to Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and Delaware), the rights granted by your applicable state law — including access, deletion, correction, and opt-out rights — may be exercised by contacting contact@drneilpatelmd.com. The operator complies with applicable state laws to the extent they apply.
3.11 Security
The Site is served over HTTPS (TLS) by its hosting provider. The operator uses reasonable technical and organizational measures to protect information in its custody. No internet transmission or electronic storage system, however, is 100% secure, and the operator cannot guarantee absolute security.
3.12 Data retention
Email correspondence is retained as long as needed to respond to your inquiry and to maintain reasonable business records, after which it may be deleted or archived. Server logs are retained according to the hosting provider's standard schedule.
3.13 Changes to this Privacy Policy
The operator may update this Privacy Policy from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be highlighted at the top of this page where practical.
